Terms of Service

1. Agreement
These Terms of Service ("Terms") govern use of the APIs, websites, and related services operated by TariffMonkee ("we", "us", the "Service") at tariffmonkee.com. By sending a request to any Service endpoint, whether directly, through software you operate, or through an autonomous agent acting on your behalf, you agree to these Terms. If you direct or deploy an automated agent that uses the Service, you are responsible for that agent's use as if it were your own.
2. The Service
The Service provides single-purpose API endpoints (for example: rendered page content, screenshots, PDFs, structured extraction, search, and research bundles) priced per call. Endpoint availability, parameters, prices, and output formats are published at /docs and may change at any time. We may add, modify, or retire endpoints without notice; retiring an endpoint never affects calls already paid and served.
3. Payment
- Paid endpoints are billed per call in USDC via the x402 protocol. The price for each call is stated in the HTTP 402 response before any work is performed; by completing payment, you accept that price for that call.
- Payment settles before processing. A call that never settles is never processed and owes nothing.
- All payments for completed calls are final. If a settled call fails on our side (an error response after payment), contact support@tariffmonkee.com with the transaction details and we will remedy it, which may include re-running the call or refunding the payment at our discretion.
- Blockchain transactions may incur network fees set by the network, not by us.
4. Fair use and rate limits
The Service enforces per-wallet rate limits; exceeding them returns HTTP 429. You agree not to circumvent rate limits, probe or attack the Service, resell raw Service responses as a competing API without transformation, or use the Service to violate any law or third-party right, including the terms of websites you direct our tools at. You are responsible for having the right to fetch, capture, or extract the targets you submit.
5. Third-party content
Most endpoints retrieve or derive output from third-party sources (public web pages, search providers, open data feeds). We do not control and are not responsible for third-party content, its accuracy, or its licensing. Output that includes third-party content is provided for your use of the Service and does not transfer any rights in that content to you.
6. No professional advice
Service output, including any scores, audits, verdicts, or assessments (for example AI-readiness or security-related reports), is informational only. It is not legal, financial, security, or professional advice, and is not a guarantee that any site, file, or counterparty is safe, compliant, or trustworthy. You remain solely responsible for decisions made using Service output.
7. Caching and logs
Responses may be cached (typically for 24 hours per input) and requests are logged for billing, abuse prevention, and service improvement, as described in the Privacy Policy.
8. Intellectual property
The Service, its software, branding, and documentation are our property or licensed to us. These Terms grant you no rights in them except the limited right to call the APIs as documented.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID TO THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL.
11. Indemnification
You will defend and hold us harmless from claims arising out of your (or your agents') use of the Service in violation of these Terms or of any law or third-party right.
12. Changes
We may update these Terms by posting a revised version at this URL with a new effective date. Continued use of the Service after a change constitutes acceptance. Material changes to payment terms never apply retroactively to calls already settled.
13. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Exclusive venue for disputes lies in the courts located in that state.
